My account was disabled for click fraud which was the result of unintentional assistance from my young daughters' friends unaware of the consequences to my account.<br /><br />I held my hands up but Google, unlike the justice system, has no room for argument or flexibility on sentence...everything is punishable by a life sentence! One word that describes this method of justice ...draconian!! Some refer to google as God, I think it would be more apt to compare them to judge dread as god does at least show compassion!<br /><br />I do believe that the small publisher is being treated unfairly and this is purely because they (google) do not want to invest their funds into finding ways of weeding out the real culprits of click fraud, who operate on a much larger scale using methods undetectable by googles' systems.<br /><br />Anyway, rant over. It still remains a fact that the adsense program is by far the best moneymaking program for publishers and therefore I would like to reapply, better the devil you know and all that.<br /><br />So the question is:<br /><br />What specifics need changing for reapplication to adsense? The reason I ask is that I have read everything from changing all(IP, IPS, NAME, EMAIL, ADDRESS, TEL NUMBERS, BANK DETAILS AND WEBSITE) to changing just name email and address only!<br /><br />I would like to use the same site as I was using when my account was disabled. It has good pagerank built up over the last twelve months, and as a result my adsense earnings had increased. <br /><br />I don't believe my site is banned as it does not contravene any of Googles TOS and has everything required in place. Privacy policy with google cookie info on etc. Also Googles terms do state that as long as the site is not banned other publishers can place there ads on it. If this is the case, can a new applicant use this site as their main website when applying or not?<br /><br />I look forward to your replies. Thank you]]></content:encoded>

Will it put customers off if i state a general 3-5 days delivery and not have a 'next day delivery' option? I'm trying to put together a simple website for my business, more of a promotional tool at the moment. I'm having a problem uploading graphical images, in jpeg form, onto the web. I'm using FTP and the text, background colours, etc are fine but the image is not. When using the FTP I have transferred the main page across (such as index.html) and also the relevant images. I'm using Frontpage for the time being and my host has extensions, would it be any less complicated using the extensions? I've also tried to use frames but messed that up completely. However, uploading the images is my main concern right now. As you can probably tell, I'm a bit of a novice at this game, but I'm learning.<br /><br />Any help is much appreciated.<br /><br />Thanks,]]></content:encoded>

			<content:encoded><![CDATA[I have been working none stop the last few weeks as I have been extremely busy although not making much profit as I am spending a fortune on expanding.<br /><br />I realised I had to expand because I was not making enough profit to have any sort of real living, I have been as busy as my ideal lately but I have found it is not the going to clients that is the problem its all the paper work. In the past if a warranty item failed I would simply repalce it out of my own pocket, however I am now RMAing stuff as I reckon I am loosing a couple of hundered a year by not doing that. It all takes time and lately I felt if I am not in bed or watching corrie I am working.<br /><br />I have run this business for four years and over the past year felt it had taken off as was not advertising at all but although my turnover is up from 08 only slightly I had spent much less on advertising meaning a slightly higher profit. I am now advertising again and hope to increase sales by 30% this will mean I can afford my own place (rented) in a nice part of town etc and not feel financialy trapped.<br /><br />The problem now is I miss my social life, the past three years it has been very active, now my mates are all moving on with GFs and such like I am now feeling a bit left behind, I still see them usualy once a week but its the holidays and things like that I miss.<br /><br />How do other people cope with the lack of social experiences when being self employed? I am starting to feel a bit lonely and I think one my cats senses that as he follows me where ever I am. He is on my computer desk as I speak.<br /><br />Just a bit fed up really, probably due too much work and not enough profit to show for it]]></content:encoded>

Organise your projects, and then break them down into tasks and subtasks, with different priorities, to create a structured to-do list. Helps keep me on track when I have multiple balls in the air.<br /><br />Freelance Switch podcast - http://freelanceswitch.com/podcasts/ (free podcast)<br />A regular (every 2 or 3 weeks) American (but still good) podcast on practical tips and advice for freelancers. It has 101 tips from advertising, to staying in contact with your customers, through to how to raise or lower your day rates and what it would mean to your business. Most of it is stuff you should already know about, but this book helps clarify the process.<br /><br />The Small Business Handbook<br />This book comes with a CD, which contains template letters, forms and a host of SME resources. The book covers everything from initial small company creation (lots of tips for freelancers and one man bands) through to finding customers, partners, creating contracts for work, and covering the legal aspects. A book I am always referencing.<br /><br />The 30 day MBA<br />MBA = Master of Business Administration. This book provides a grounding on the main topics, which will help you understand if your small SME or freelance business is doing ok. It covers subjects like cach flow, profit and loss, cost of sales, balance sheets, VAT returns, year ends etc, plus moves into advertising, sales generation etc. It is all covered at a level where you know what it all means, without being too taxing. With the information in hand, conversations with your accountant become a lot easier.<br /><br />Direct and Interactive Marketing<br />The most expensive book of the bunch, but worth its weight in gold. This covers marketing your SME and freelance business, in an IT world. So whilst it covers topics such as newsletters, marketing letters and so on, it then covers web sites, SEO, emails (the good, the bad and the pitfalls), Google Adwords (how to setup, use and get the best results). In a nutshell, its a guide on finding new customers without getting banned from Google or being reported for spamming.<br /><br />Jack Canfield - The Success Principles<br />This is my joker (wildcard) in the pack. Whilst this is not strictly related to running a freelance SME, Jacks principles are very useful for staying positive through the process of running a business (and life), taking rejection well, and being a stronger person. However, he also covers growth, such as finding a mentor or support group (such as chamber of commerce or FSB) to help your business along. A good read, crammed full of very good advice.<br /><br /><br /><br />There are a bunch more I could add, but out of my 30 or so business books I read when starting my freelance company, these 5 were the most useful, and books I come back to time and time again.<br /><br />Thats my list. I am yet to finish the setup of it for a company now, but it seems it does support multiple ledgers and I although I havent deployed SAP before, I have a feeling it fares quite well against it. and the best part of it for me is:<br /><br /><b>- Free<br />- Integrated CRM<br />- stock/purchasing control<br />- multi-currency<br />- installs on both - linux and windows</b><br /><br />the software has hundreds of available free modules, such as manufacturing, project management, servicing etc, yet I dont need them in this setup.<br /><br />Either way, would be great to hear if anyone is using this and how are you finding it?]]></content:encoded>

Therefore we decided to add a function in our ecommerce website for African customers to input their vat number, this will be validated automatically, resulting in VAT free export for some Africa countries.<br /><br />My questions is:<br />1. Is it possible for my website to validate the VAT numbers automatically, and if it is valid the customer will then be able to continue without VAT being applied?<br />2. How can I prevent a user from using a VALID VAT number belonging to another company? Therefore making a VAT free purchase which they are not entitled to. From my understanding, VAT numbers can be verified but not to a specifc company.<br />3.If point 2 occurs, would we be liable for VAT on the item?<br /><br />Thanks]]></content:encoded>

			<content:encoded><![CDATA[EAC competition law imposes $100,000 fine  	<br />Written by DAVID MUWANGA   <br />Monday, 21 December 2009<br /><br />KAMPALA, UGANDA &#8212; A competition law that will protect small firms from the business giants in the East African Community (EAC) region will soon be implemented.<br />The law is being amended to impose a fine of $100,000 to companies that suffocates small and medium enterprises and interfere with free movement of goods and services in the region.<br /><br /> The law has been drafted by the EAC secretariat in Arusha.<br /><br />The EAC Competition Act of 2006 that is being amended to become the EAC Competition Regulations 2009 will include Rwanda and Burundi that joined the EAC recently.<br /><br />It is also being amended to include five commissioners, one from each country who will work as Judges in cases that will emerge from the companies that will be sued for legal action.<br /><br />The amended law also sets up the EAC Competition Authority that will have the responsibility of initiating cases, gathering information, searching and seizure of documents and imposition of sanctions depending on the gravity of the case.<br /><br />In the worst cases, the law will impose a fine of $100,000 or company officials that will be found guilty will be given a general penalty of not more than $10,000 or imprisonment for a period of two years or both and paying for the compensation for damages.<br /><br />When established, the EAC Competition Authority will seek to promote and protect small and medium enterprises, individuals, organization and associations within the region following the signing of the EAC Common Market Protocol by the Heads of State of November 20. The Common Market whose implementation starts in July next year allows free movement of goods, labour, services and capital.  It includes the complete elimination of all tariff and non-tariff barriers and a common external tariff.<br /><br />&#8220;It is also aimed at ensuring fair trade and consumer welfare. If one company for example in Kenya behaves in a way that affects another company in another country, it is the EAC law that will be applied,&#8221; Mr. Jean-Guy Afrika, the EAC senior trade officer said.<br /><br />&#8220;But if a company does something that affects the citizens of that country, it is the national competition law that is to be applied,&#8221; he said.<br /><br />Today, it is only Kenya and Tanzania that have competition laws.<br /><br />This means that Uganda, Rwanda and Burundi have to expedite the process of setting up their own laws in order to be ready for the Common Market.<br /><br />The Act prohibits collusion to fix prices, collusion in bidding, market allocation and prohibits all factors that will hurt free movement of goods and services and free trade.<br /><br />&#8220;Although market dominance is not illegal per see, the new law prohibits this because it has been abused by companies that impose unfair prices making it difficult for small companies to enter the market,&#8221; Afrika said.<br /><br />When the law comes into force, companies wishing to merge will have to notify the authority for approval.<br /><br />&#8220;Partner states shall notify the authority before granting any subsidies that will within forty five days after receipt of the notice notify the partner state of its decision,&#8221; Afrika said.<br /><br />Where the authority fails or neglects to communicate the decision of an intended grant of subsidy, such subsidy may be implemented.<br /><br />The authority shall refer that matter to the court if it discovers that a partner state granted a subsidy in contravention of the Act.<br /><br />When the court determines that the subsidy granted was illegal, threatens or distorts competition in the region, court shall order the state to recover it from the recipient company.<br /><br />Tanzania&#8217;s director general for the Fair Competition Commission, Mr. Godfrey Mkocha said the EAC law was drafted by experts from Uganda, Kenya and Tanzania.<br /><br />&#8220;So the EAC law is supreme over the national laws and since we are members of the international competition network, we cannot handle cases differently from other member states of the network,&#8221; he said.<br /><br />Kenya&#8217;s Commissioner for Monopolies and Prices, Mr. Wang&#8217;ombi Kariuki said his country is coming up with the Competition Bill 2009 to close loopholes in the old national competition laws.<br /><br />&#8220;The new bill establishes an autonomous agency to revise enforcement procedures, expand mergers and takeovers that require authorization and introduce consumer protection,&#8221; Kariuki said.<br /><br />He said this will in future be harmonized with the EAC Competition law it also introduces tax exemptions and abuse of dominance clauses that were missing in the old law.]]></content:encoded>

Some are obvious, some are bizarre. Some are old, some are new. Many are well know techniques, some are my own personal rambling. Nothing is a statement of fact, merely my own opinion.<br /><br />   1. If you're launching a new site, or new content, write an introduction and submit it to share sites like <a href="http://www.digg.com/">Digg</a>, <a href="http://reddit.com/">Reddit</a> and N<a href="http://www.nowpublic.com/">ow Public</a>.<br />   2. Create a <a href="http://groups.yahoo.com/">Yahoo Group</a> in the niche your site sits.<br />   3. Create a <a href="http://www.myspace.com/">MySpace</a> and a <a href="http://www.facebook.com">Facebook</a> account and use it to publisise your site.<br />   4. Bookmark your site on <a href="http://del.icio.us/">Del.icio.us</a> and if you're really keen, add a Del.icio.us button to your homepage.<br />   5. Create a <a href="http://www.technorati.com/">Technorati</a> account and "claim" your blog.<br />   6. Submit your site to free, search engine friendly directories. An excellent list can be found here.<br />   7. Conduct a survey. This is an excellent way to generate offline publicity.<br />   8. Place a free ad for your company on Gumtree.<br />   9. Syndicate your site's content by using an RSS feeds.<br />  10. Submit your RSS feeds to agregator sites like <a href="http://www.feedburner.com/">FeedBurner</a>, Squidoo, Feedboy, Jordomedia, FeedBomb, FeedCat, rssmad, feeddirectory and feedfury. Nothing appears more amateur than a site with typos or spelling mistakes.<br />  18. Test your site and make sure it appears correctly in all major browsers.<br />  19. Buy enough hosting. No one likes a slow site.<br />  20. Don't worry about PageRank - worrying about PageRank is as effective as trying to solve an algebra equation by chewing bubblegum.&#42;<br />  21. Offer something for free. Free is good. People tell their friends about free stuff.<br />  22. Tell your neighbours, you never know what contacts they might have.<br />  23. Offer your users as many ways as possible to contact you. MSN, Skype, Yahoo etc all complement email, phone and a real address.<br />  24. Advertise your site on Craigslist. It's free, relevant and localised.<br />  25. Do NOT use frames.<br />  26. Submit your site to DMOZ.org. It may take time, but it's worth it.<br />  27. Create an XML sitemap of your site and submit it to Google.<br />  28. Get a custom t-shirt made with your website url on it, and wear it often.<br />  29. Ask a large breasted lady to wear one too.<br />  30. Sign up with an affiliate programme to sell your product, or if you're a publish, make some cash!<br />  31. On your Contact Page ask people if they mind receiving your newsletter.<br />  32. Send out a newsletter!<br />  33. Go to a free seminar for Website owners. You might learn something.<br />  34. Find quality and relevant blogs and leave a comment (with a link back to your site of course).<br />  35. Don't pay people to submit your site to search engines. It's a waste of money.<br />  36. YouTube and Google Video are excellent portals on which to launch a viral campaign.<br />  37. Giving away an eBook is an excellent way to generate word-of-mouth about your site.<br />  38. Sponsor a Wordpress theme or a phpListDirectory template.<br />  39. If you sell products that are advertised on television by the manufacturer, add "As Seen on TV" to your site!<br />  40. Avoid proprietry technologies like Java and Active X.<br />  41. Put downloadable content on your site, but make sure it's not manufacturer specific - so mp3 rather than wma.<br />  42. Learn about CSS. It's the new HTML.<br />  43. Contribute to related subject areas on Wikipedia.<br />  44. Ask bloggers and other Web site owners to review your site and/or products.<br />  45. Have user friendly page names - most tools comes with some way to avoid http://www.yourdomain.com/pgInfoPage...CFE3AEDAF8DD9D<br />  46. If you must have a Flash homepage, make sure you have a "Skip Intro" link.<br />  47. Tell your local rag about your site. These newspapers are desparate for stories and you may well even get a pic of your ugly picture published.<br />  48. Become a leading authority on your chosen subject.<br />  49. 			<content:encoded><![CDATA[<b>The role of the Moderator</b><br /><br />As we have already acknowledged that the role of the Moderator is indeed a difficult one and in most cases they have to make a decision based on objectivity.<br /><br />In law, Moderators can be held liable for any statement that appears to be defamatory because forum members are deemed to be 'authors' within the meaning under s.1(2) of the Defamation Act 1996. There is no question as to liability that an author will be liable for any defamatory statement. As for a Moderator, who has 'some element of control in publishing a defamatory statement' is likely to fall within the meaning of s.1(2) of the same Act and will therefore be held liable.<br /><br />With reference to previous threads, in my opinion, Moderators were correct to remove and/or lock a thread that has no purpose, whether defamatory or not, but has reference to the reputation/goodwill of a person(s) or undertaking.<br /><br />In the circumstances, the Moderators as 'publishers' reasonably allowed for the appropriate person to put forward his/her reasoning behind the allegation to afford the recipient to defend accordingly. The person who made the 'allegation' did not take the opportunity to substantiate the allegation nor did the person take the opportunity to post a formal apology and/or correction.<br /><br />The Moderators allowed a reasonable amount of time for the issues to be addressed by the parties involved and as they were not forthcoming but were being further aggravated by other inappropiate comments, it was just and right to lock and remove the thread.<br /><br />Having said the above, I hope this posting goes some way for us all in understanding the dilemma Moderator's face in reaching decisions as 'ordinary men'<br /><br />PS.
